I understand that I am providing my own garment to be embroidered by Custom Merchandise Market. I acknowledge that Custom Merchandise Market is not responsible for any defects or damages that may result from the embroidery process or that may have existed prior to the embroidery process, including but not limited to pilling, stretching, or damage to the garment.
I further understand that Custom Merchandise Market will make every effort to ensure the accuracy of the embroidery, but due to the nature of the embroidery process, there may be slight variations in color, placement, and size. I acknowledge that these variations are inherent in the embroidery process and do not constitute defects or damages.
I agree to hold harmless and release Custom Merchandise Market, its employees, officers, agents, successors, and assigns from any and all claims, damages, losses, or expenses arising out of or related to the embroidery of my garment, including but not limited to claims for breach of contract, negligence, or any other cause of action.
If we have supplied the garment or item, we have calculated a margin of error in the cost and will replace it. We cannot replace garments or items we have not sold or provided. If you supply the garment or item and there is a problem, we do not replace your item. Your damaged piece will be returned to you as is. Problems do not arise often, but the customer must be aware and agree to the possibility.
I affirm that I have read and fully understand the terms of this waiver, and that I am voluntarily providing my garment to be embroidered by Custom Merchandise Market with full knowledge and acceptance of the risks involved.
